Alright I am over my way earlier hizzy fit over the unauthorized use of my stock. After much consideration I have decided that I am no going to let a few bad apples spoil the entire bunch for the rest of us.
I am going to keep this account open and once again start adding new stock.

I still haven't decided whether or not I want to go back to a paid account here or not. I might try it out again, and add a few more donator packs, to see if I can off set the cost. That is if anyone is interested in donators packs.
I have loads of new pngs, to post that I hope everyone finds useful in some way. Will be adding them off and on for the next couple of days.

Added: Over the coarse of the next week I will be deciding whether or not I am closing this account
and all my accounts at dA. Honestly I just don't agree with share links, and legalities
they represent. For years I have seen many places on the web get their hooks
into users content, and it has just gotten worst.
So I figure I am just out growing dA and other places. If I keep my art on just my web site,
I am in more control of my content. Yes someone might still steal it
but if that happens I will know it was stolen, not legaly given away
by TOS of some site that my art was shared on by dA or any other site.
Important Rule Changes for Stock and Psd Files
First my apologies to all those loyal wonderful watchers of mine,
that have followed and respected my rules. It really breaks my heart that you will be
hurt the most by my rule changes. But I do hope that you will understand
my need to protect my work form those too dishonest to follow the rules.
Read on through the journal and if you want to download with out
going through the new procedure, do it soon, the down load links are'
coming down over the next few days. Remember that any thing you download from the date
of this journal post on must follow the "new rules". The only reason the files are being taken down one step
at a time is because of time restraints.
As those of you that make stock know, and for those of you that don’t, stock artist put lots of time and effort into providing quality stock. Thanks to the efforts of some dishonest people, and people who think it is perfectly acceptable to steal and profit from that theft I have to take steps to protect myself, and my work
from this day forth.
Due to distasteful circumstances I have decided to rework my stock rules,
and to cut off the commercial options I have allowed before with stock usage.
I have come to the decision that for commercial use a license fee is the only way to go. Maybe if folks have to pay for this stock use to make money they will value it more.
So effective immediately all stock downloaded from this account is NOT available
to be used for commercial uses with out the purchase of a restricted commercial usage license.

To all those who have already downloaded my files,
this rule does not apply for downloads that were
downloaded before the posting of this journal,
or to art already made before the posting of this journal entry.
I will be working through out the weekend to remove all down load links from my stock also. If after the links are gone you wish to have that stock whether psd file or image for either personal or commercial use you will have to note me, letting me know what image or psd file you want, and we will proceed from there with either the free personal use down load link option via dA note, or the commercial restricted license options via email communication and payable invoice.

NEW STOCK RULES
(these rules apply to all stock, both photographs and PSD files)
EFFECTIVE August 20, 2009
1. Commercial usage will only be allowed with the purchase of a restricted license
from now on, this includes dA print sales.
Commercial licenses charges will be at a highly discounted rate for dA members
only. (to purchase a license email gina@briarmoon.com with the image or psd
file you wish to license and an invoice will be sent to you via paypal, once the
invoice has been paid, and I have received notification of payment,
a down load link to the file and license will be emailed to you)
2. Personal usage (not for profit or sale of any form) is still allowed.
Credit must be given to this stock account as shown below, where ever this personal work is posted
in public environment or forum. I.E. The World Wide Web,
Non Profit Work Shops, such as scrap booking clubs, children’s clubs, etc.
3. Violations of the rules will bring swift justice, and require removal of the art or item made
with the stock or psd file in question from said public forum.
4. Commercial use violators will be billed a fee based on standard commercial rates for a license, and a fee of 35% of past sales collected using the photo or psd file. Plus be required to sing a contract agreement for a %10 of all future sales if they wish to keep suing my image.
5. If the bill is ignored I can and will file a civil suite to seek recompense for the damages afforded to me by international copy right regulations, and laws. This includes fees for a license, royalties from any past sales, and all attorney and court costs.
Discounted Restricted License Fees for dA members are as follows:
One image, or one layer psd file $1.50 per image or file
Two to Three Layered PSD Files $1.95 per file
Three or more images or single layered psd files $.75 per image or file
Two or more single images for single psd files $. 50 per image or file
Multi Layered PSD Files (three or more layers) $2.50 per file
Note to dA members, note me and let dsicuss commerical usage
we might be able to barter for something, if you are feeling
the economic pinch like most of us.
***Terms of a Restricted Use License
You can use the image or files you purchased for commercial use that does not included.
Mass productions of items using the image that exceed 100 items* per image. You may not resale the image or file in any other stock pack, or as is for any reasons. The image or file must be not be extractable for the item you use it on.
* 100 items per image: this includes all items made for the image or file together,
I.E. Not 100 prints, 100 t-shirts, 100 mouse pads, but
20 prints, 20 t-shirts, 20 mouse pads, etc, until he total 100 is reached.
With this license you don not have to credit this stock account or provided any links back to this stock account or the Briar Moon web site.
For any commercial project needs you have that over a 100 total items, please contact gina@briarmoon.com for standard commercial license rates.
Rates can be worked out in flat per image or file fee, or if you can provide proof of a solvent long term business with documentation, a smaller flat fee and percentage per sale agreement might be able to be reached.
